Definitions:
- OnlyServers: Refers to Packet Star Networks Limited, trading as OnlyServers.
- Customer: Any individual or entity purchasing or using services from OnlyServers.
- Dedicated Server: A physical bare metal server allocated exclusively to one customer.
- Data Controller: As defined under data protection regulations, including but not limited to the UK General Data Protection Regulation (UK GDPR) and the EU General Data Protection Regulation (EU GDPR), a Data Controller determines the purposes and means of processing personal data.
- Data Processor: A person or organization that processes data on behalf of a Data Controller.
- Services: The dedicated server hosting and related support services provided by OnlyServers.

Service Description
Our dedicated server services provide hosting solutions for your websites, applications, or other online services. These services include the provision of dedicated (bare metal) server hardware, network connectivity, and related technical support. -
Payment and Billing
- You agree to pay all fees and charges associated with your use of our services.
- Fees are based on the selected server configuration and support options.
- Payments are accepted via Stripe. Payment methods, including debit/credit cards, may vary depending on your country or region.
- Servers are billed monthly, unless another billing cycle is chosen.
- You may cancel your server at any time by disabling automatic renewal in your control panel.
- Failure to cancel your server before the renewal date will result in liability for the next billing cycle.
- In the event of non-payment or suspension, no refunds will be issued.
- If payment is overdue by more than 7 days, your server may be cancelled, and any paid or remaining time forfeited.
- Taxes may apply and may vary from time to time. Customers agree that tax changes do not constitute a price change.
- Refunds are not provided, except where required by applicable law.

Cancellation and Refund Policy
- If you are unsatisfied with your server, you may disable renewal or cancel your service.
- Under no circumstances are refunds provided, except where required by applicable law.
- Services are sold to businesses or for business use only. We do not offer products directly to consumers.

Service Level Agreement (SLA)
- We strive for high performance and availability across our network.
- 100% uptime is guaranteed for network routing availability to and from any Tier 1 transit provider.
- 99% packet delivery is guaranteed over our internal network on a monthly basis (edge-to-edge, not internet-wide).
- No financial compensation is provided for missed uptime or packet delivery targets. The sole and exclusive remedy for SLA breaches is service cancellation with a pro-rata refund of prepaid amounts.
- All support tickets will be responded to within 24 hours.
- Hardware fault investigations will be initiated within 24 hours, and alternative solutions may be offered if necessary.
- The customer’s sole remedy for SLA breach is to cancel their service and receive a pro-rata refund of prepaid amounts.
- The SLA does not apply during any period of service suspension due to AUP violations or non-payment.
- Scheduled maintenance periods are excluded from SLA uptime calculations.

Acceptable Use
You agree to use our services in compliance with all laws and our Acceptable Use Policy. Activities that are prohibited include, but are not limited to:- Engaging in illegal or fraudulent behavior.
- Transmitting malware or malicious content
- Violating intellectual property rights
- Breaching privacy rights
- Streaming of copyrighted material

Hardware & Maintenance
- Dell iDrac is available for reinstallation of operating systems. Tampering with or changing critical settings on iDrac may impact our ability to provide support and voids any related SLA claims.
- It is the customer's responsibility to report hardware failures.
- We may require full access to your system for testing and diagnostics, which may temporarily make it unavailable.
- Hardware may be replaced as part of ongoing maintenance. Compatibility of your data or setup cannot be guaranteed.

Security and Responsibility
- Passwords are provided on handover. We strongly advise you to change all credentials and enable any encryption options available in the platform or operating system.
- OnlyServers is not liable for any system compromise, including those caused by negligence.
- The customer is solely responsible for server administration, software, and license compliance.
- No backups or data recovery services are included. Customers must manage their own backups.
- We do not guarantee that any installed software will function correctly or that it will not damage your data.

Data Protection and Privacy
- All data uploaded or stored is your sole responsibility.
- You are responsible for complying with all data protection regulations, including GDPR (EU and UK versions), where applicable.
- For the avoidance of doubt, OnlyServers acts solely as an infrastructure provider. We are not a Data Processor or Data Controller for your content.
- A Data Controller is the individual or organization that determines the purpose and means of processing personal data.
- A Data Processor acts on behalf of a Data Controller and processes data under their instruction.
- We do not access, manage, or interact with your data unless required by law.
- We may provide access to your data or servers to law enforcement upon lawful request.
- We may collect and log traffic and usage metrics for service monitoring, abuse prevention, and internal analytics. These logs may include traffic volumes, port access, bandwidth usage, and connection metadata, but do not include content unless required for security investigations or legal compliance.

Bandwidth and Usage
- If you select a metered bandwidth plan, you agree to pay any overage fees as published on our website.
- You accept OnlyServers' bandwidth meters or usage estimates as accurate.
- Exceeding this threshold may incur charges that OnlyServers deems reasonable.
- SSDs are subject to write endurance limits. Customers agree not to exceed 1% of total write endurance per calendar month.
- Customers must not abuse any resource in a way that causes financial loss to OnlyServers.

Denial of Service Attacks
In the event of a denial of service (DoS or DDoS) attack:- We reserve the right to block or restrict access to affected IP addresses.
- We may suspend the impacted service entirely to protect our infrastructure.

Intellectual Property
- All software, content, and systems provided by OnlyServers are the intellectual property of OnlyServers or our licensors.
- Operating systems installed on servers (e.g., Ubuntu, AlmaLinux, Windows Server) remain the intellectual property of their respective owners.
- You are granted a non-transferable, limited-use license strictly for use with our services.
- We retain all rights not expressly granted herein.

Term and Termination
- These terms remain in effect for as long as you use our services.
- Either party may terminate service by providing notice.
- Upon termination, you must cease use of all equipment and OnlyServers shall be free to provide those to another customer without interference.
- Upon termination or cancellation, all data stored on the server may be erased. OnlyServers may delete or erase data upon termination but makes no guarantee regarding the secure destruction of such data. Customers requiring certified secure destruction must request this service in advance via our sales team and may incur additional costs.

Limitation of Liability
- OnlyServers are not liable for any indirect, incidental, or consequential damages.
- This includes, but is not limited to, data loss, business interruption, or lost profits.
- We make no guarantees that software or services will be error-free.

Force Majeure
- OnlyServers shall not be held liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, cyberattacks, governmental actions, or widespread network outages.

Assignment
We reserve the right to novate this agreement or assign all obligations and rights to a third party without notice or your consent. -
Governing Law and Dispute Resolution
- These terms are governed by the laws of the United Kingdom.
- All disputes will be exclusively resolved in the courts of the United Kingdom.
- For international customers, we may, at our discretion, agree to resolve disputes through binding arbitration.

Amendments
- We may update these Terms at any time without prior notice.
- Changes become effective immediately upon posting on our website.
- It is your responsibility to review these Terms periodically.
